II. Legal Obligations for Enterprises
Regarding the SVHCs on the list, EU regulations set clear compliance requirements for enterprises in different roles (suppliers, importers, manufacturers, etc.), which are specifically divided into the following four categories:
1. Product Information Transmission Obligation (for Suppliers)
If the concentration of an SVHC in a product exceeds 0.1% by weight, the supplier must provide sufficient information to customers and consumers to ensure the safe use of the product (such as usage precautions and risk prevention measures).
2. ECHA Notification Obligation (for Importers and Manufacturers)
3. Safety Data Sheet (SDS) Provision Obligation (for Suppliers of SVHCs)
If a supplier supplies a substance from the SVHC Candidate List alone or supplies a mixture containing such a substance, they must provide a Safety Data Sheet (SDS) to the customer, specifying the physical and chemical properties, hazard information, protective measures, and emergency response methods of the substance.
4. SCIP Notification Obligation (for All Suppliers of Products on the EU Market)
In accordance with the Waste Framework Directive (Directive 2008/98/EC, WFD), since January 5, 2021, if the concentration of an SVHC in a product exceeds 0.1% by weight and the product is sold on the EU market, the supplier must submit a "Substances of Concern In articles as such or in complex objects (Products) (SCIP)" notification to ECHA.
